Basement finishing in Chicago, IL
A Chicago basement can be good living space, but it sits on a combined sewer and under whatever ceiling height the original builder left. Here is what the city's codes actually require before you frame a wall down there.

Ceiling height
When Chicago moved to its 2019 Building Code, the Department of Buildings told builders that the minimum ceiling height dropped from 7 feet 6 inches to 7 feet. The stated aim was to let people convert basements and attics without digging out or adding dormers.
That 6 inches matters in a bungalow basement. Measure from the finished floor you plan to the finished ceiling you will actually have once ductwork and framing are in, not to the bottom of the joists. If you are short, the Chicago Bungalow Association's basement scheme notes that digging out for height is an expensive option, so it is worth knowing before any design work starts.
Light, air and fire separation
In the same presentation the city said the new code has no requirement for egress windows. Light still applies. For a new basement bedroom in a home with more than 40 percent of its floor area above grade, the glazed area must be at least 6 percent of the room's floor area, and mechanical ventilation at 0.35 air changes per hour can stand in for opening windows.
In a single family house the floor over the basement usually does not need a fire rating, so drywall on the ceiling is a choice. In a two flat it depends. If the basement is storage or part of the first floor unit, no rating is required. If it becomes its own unit, the floor above must be fire rated.
Water first
MWRD explains that in Chicago's combined sewers, basement backups often happen because rain enters the local sewer faster than it can flow out. A finished basement with a floor drain tied straight to that sewer is exposed every heavy storm.
The Chicago Bungalow Association's flooding guide lists the usual fixes: a backwater valve, a standpipe in the floor drain, a sump or ejector pump, and an overhead sewer. Its basement design scheme recommends an overhead sewer with a sewage ejector pump. The Chicago Plumbing Code requires drainage piping below sewer level to be vented the same way as a gravity system, with sump vents sized for the ejector. We plan that layout before the slab is cut for a bathroom.
We also choose materials that tolerate damp: no paper faced products against foundation walls, and a vapour barrier under the floor finish.
Permits and basement apartments
Finishing an existing basement without changing the building's volume counts as an alteration under the Building Rehabilitation Code, not an addition. The Express route will not cover it if the space is unheated today, or if it has never been legally occupied, and the job needs a plan based permit with drawings instead.
A separate unit is a bigger step. Since the September 2025 expansion of the Additional Dwelling Unit ordinance, a basement conversion unit is allowed by right in multi unit zoning districts and inside ADU Allowed RS Areas elsewhere, in buildings at least 20 years old, after a Department of Housing pre certification. If a past owner built a basement unit without permits, the Express Permit Program has a deconversion route to remove the kitchen or bathroom and return the space to legal use in a one to three unit building.

Does a finished basement count against my zoning floor area?
Usually not. Chicago's zoning code counts a below grade floor only when more than half of its floor to ceiling height is above grade, and not at all if its clear height is under 6 feet 9 inches.
Do I need an egress window for a basement bedroom in Chicago?
The Department of Buildings told builders the 2019 code has no egress window requirement for small residential buildings. You still need natural light of at least 6 percent of the floor area for a basement bedroom in a home with more than 40 percent of its floor area above grade.
